SoldOutRadar Terms of Service

1. Who We Are & Acceptance of Terms

SoldOutRadar ("SoldOutRadar," "we," "us," or "our") is an availability-monitoring and alert service operated by Jean-Baptiste Renaldi, a French sole proprietorship (micro-entreprise / auto-entrepreneur), registered in France under SIREN 977 775 451 (SIRET 977 775 451 000 15), with a registered address at 330 Chemin du Vallon des Gavots, 13400 Aubagne, France. These Terms of Service ("Terms") govern your access to and use of our website (https://soldoutradar.com), alerts, and related services (collectively, the "Service").

By creating an account, making a payment, opting in to receive messages, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and that the information you provide is accurate.

You are responsible for completing your own booking on the official site, for paying the official ticket price to that site, and for complying with that site's terms, rules, eligibility limits, and cancellation policies (for example, the official limit of one Crown ticket per person per six months).

SoldOutRadar helps you find openings — it cannot create them.

5. Fees & Refunds

Paid plans are a one-time fee for a digital monitoring service that we begin performing immediately, as soon as your payment is confirmed.

Nothing in this section limits any non-waivable refund or consumer-protection rights you may have under the mandatory law of your country of residence. To contact us about your fee, email hello@soldoutradar.com from the email address used at purchase.

6. Alert Channels; SMS Terms (When Available)

Alerts are currently delivered by email and instant push notification. SMS text alerts are not yet available; we plan to offer them on paid plans once our carrier registration is complete, at no extra charge. If and when SMS alerts become available and you provide a mobile number and opt in, you agree to the following:

7. Your Data & Privacy

To deliver the Service, we collect and use only the data we need: your email address; your mobile phone number (optional — only if you opt in to SMS alerts, when available); your travel dates; your departure point (New York / Battery Park, New Jersey / Liberty State Park, or both); and your group size. We use this information only to provide the Service and deliver your alerts. We never sell your personal data.

We rely on the following sub-processors to operate the Service: Stripe (payments), Brevo/Sendinblue (email), Twilio (SMS, if and when SMS alerts are offered), Supabase (hosting/database), and Vercel (web hosting). Some of these providers may process data outside your country, subject to appropriate safeguards.

GDPR (EU/EEA/UK). Where the EU/UK General Data Protection Regulation applies, you have the right to access, correct, delete, restrict, or object to the processing of your personal data, the right to data portability, and the right to lodge a complaint with your local supervisory authority. The data controller is Jean-Baptiste Renaldi. To exercise these rights, contact us at hello@soldoutradar.com.

California (CCPA/CPRA). If you are a California resident, you have the right to know what personal information we collect, to request access to or deletion of it, and to correct inaccurate information. We do not sell or share your personal information as those terms are defined under California law, and we will not discriminate against you for exercising your privacy rights. 8. Acceptable Use

You agree to use the Service only for your own lawful, personal purposes. You agree that you will not:

We may suspend or terminate your access at any time, without refund, if we reasonably believe you have violated these Terms.

9. Disclaimers of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that openings will be detected; that alerts will be delivered or delivered on time; or that you will be able to obtain any ticket, tour, or reservation. You use the Service at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, SoldOutRadar and its operator, owners, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost opportunities, lost bookings, or missed events, arising out of or relating to the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any and all claims relating to the Service is limited to the amount you actually paid us for the Service giving rise to the claim. For the free test plan, our total liability is limited to USD $0.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Changes to the Service or These Terms

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We may also update these Terms from time to time. When we do, we will revise the "Effective date" above and, where appropriate, provide notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, stop using the Service.

12. Governing Law & Venue

SoldOutRadar is operated from France. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of France, without regard to its conflict-of-law rules and without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

The parties agree to submit to the exclusive jurisdiction of the courts located in Marseille, France to resolve any dispute, except where applicable law gives you the right to bring proceedings in another forum.
