SoldOutRadar Terms of Service
Effective date: July 2, 2026
1. Who We Are & Acceptance of Terms
SoldOutRadar ("SoldOutRadar," "we," "us," or "our") is an availability-monitoring and alert service operated by Jean-Baptiste Renaldi, a French sole proprietorship (micro-entreprise / auto-entrepreneur), registered in France under SIREN 977 775 451 (SIRET 977 775 451 000 15), with a registered address at 330 Chemin du Vallon des Gavots, 13400 Aubagne, France. These Terms of Service ("Terms") govern your access to and use of our website (https://soldoutradar.com), alerts, and related services (collectively, the "Service").
By creating an account, making a payment, opting in to receive messages, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and that the information you provide is accurate.
2. What the Service IS — and What It IS NOT
Please read this section carefully. It is the most important part of these Terms.
What the Service IS
- SoldOutRadar monitors official ticketing availability for sold-out or hard-to-get spots — beginning with Statue of Liberty Crown access sold through the official site, Statue City Cruises (statuecitycruises.com).
- When we detect that a spot appears to have opened up, we send you an alert (by email and instant push notification) so you can act quickly.
- That is the entire scope of the Service: we monitor, and we alert. We sell you the information — never a ticket.
What the Service IS NOT
- We do NOT sell, resell, broker, or transfer tickets, tours, or reservations. We are not a ticket marketplace, we are not a reseller, and we hold no inventory.
- We do NOT book, reserve, purchase, or hold anything on your behalf, and we never touch your reservation. When you receive an alert, you book the ticket yourself, in your own name, directly on the official site (e.g., statuecitycruises.com), using your own account and payment method.
- We are an independent service. We are NOT affiliated with, endorsed by, sponsored by, or connected to Statue City Cruises, City Experiences, the National Park Service (NPS), or any other venue, operator, ticketing platform, or government agency. All names, trademarks, and brands are the property of their respective owners and are used for identification purposes only.
You are responsible for completing your own booking on the official site, for paying the official ticket price to that site, and for complying with that site's terms, rules, eligibility limits, and cancellation policies (for example, the official limit of one Crown ticket per person per six months).
3. Plans, Pricing & One-Time Fees
We offer the following plans. Each fee is a one-time fee per trip, charged in U.S. dollars (USD):
- Free test — no charge. A single-day watch for one person, email alert only, limited to one alert (the watch then ends). One free test per person.
- Quick — one-time fee of $19. A watch window of up to 3 days for one person, alerts by email and instant push notification, and unlimited alerts until you book.
- Full — one-time fee of $29. A watch window of up to 14 days, alerts by email and instant push notification, and unlimited alerts until you book. Includes an optional group watch for 2–3 people at no extra charge (we then alert you when 2–3 spots open together).
Key points about pricing:
- Paid plans are a one-time fee — not a subscription. We do not automatically rebill you on a recurring basis for the same watch.
- Your fee pays only for our monitoring and alert service. It is never a payment for a ticket, tour, reservation, or any admission. You pay the official ticket price separately, directly to the official site, if and when you choose to book.
- All fees are stated and charged in U.S. dollars (USD) unless otherwise indicated. You are responsible for any applicable taxes.
- Payments are processed by Stripe. We never see or store your full card number.
- Prices and plan features may change over time; the price and plan in effect at the time of your purchase apply to that purchase.
4. No Guarantee of Availability
SoldOutRadar helps you find openings — it cannot create them.
- Spots may or may not open up during your watch window. Availability depends entirely on third parties (cancellations, released inventory, operator decisions) that are outside our control. We do not promise that any spot will become available. There is no official waitlist and no same-day Crown availability.
- What we commit to is the monitoring and alerting effort — we will work to detect openings and notify you. We do not, and cannot, guarantee a booking, a reservation, or a successful purchase.
- Speed-to-book is on you. Openings can disappear within minutes. From the moment we send an alert, it is your responsibility to act quickly and complete the booking yourself on the official site. We are not responsible if a spot is taken before you complete your booking.
- Alerts depend on factors outside our control, including third-party site behavior, carrier and network delays, and your device settings. We do not guarantee that every opening will be detected or that every alert will be delivered, delivered on time, or delivered without error.
5. Fees & Refunds
Paid plans are a one-time fee for a digital monitoring service that we begin performing immediately, as soon as your payment is confirmed.
- Immediate start; no right of withdrawal once performed. By purchasing a paid plan, you expressly request that we begin the Service immediately, before the end of any statutory withdrawal period, and you acknowledge that you lose any right of withdrawal once the Service has been fully performed (a valid alert delivered). A "valid alert" means an alert for an opening matching the dates and departure point of your watch at the time it was sent.
- Fees are non-refundable once monitoring has begun. What you pay for is the detection and the alert itself — never the ticket or the booking, which you complete yourself on the official site — so the fee is earned whether or not a spot ultimately opens, and whether or not you complete a booking in time (see Section 4, "Speed-to-book is on you").
- Our one guarantee. If your watch window ends and we never delivered a single valid alert for your dates, contact us and we will refund your fee in full. This is the only circumstance in which we provide a refund.
Nothing in this section limits any non-waivable refund or consumer-protection rights you may have under the mandatory law of your country of residence. To contact us about your fee, email hello@soldoutradar.com from the email address used at purchase.
6. Alert Channels; SMS Terms (When Available)
Alerts are currently delivered by email and instant push notification. SMS text alerts are not yet available; we plan to offer them on paid plans once our carrier registration is complete, at no extra charge. If and when SMS alerts become available and you provide a mobile number and opt in, you agree to the following:
- Consent. By opting in, you consent to receive recurring automated text messages from SoldOutRadar related to your watch and account (such as availability alerts and service notices). Consent is not a condition of any purchase.
- Message frequency. Message frequency varies and depends on availability activity for your watch.
- Costs. Message and data rates may apply according to your mobile plan. SoldOutRadar does not charge for the text messages themselves.
- Opt-out. Reply STOP at any time to cancel and stop receiving messages. You may receive a confirmation message after you opt out.
- Help. Reply HELP for help, or contact us at hello@soldoutradar.com.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to the effective transmission of your carrier and is not guaranteed.
- You confirm that the mobile number you provide is yours and that you are authorized to receive messages at it.
7. Your Data & Privacy
To deliver the Service, we collect and use only the data we need: your email address; your mobile phone number (optional — only if you opt in to SMS alerts, when available); your travel dates; your departure point (New York / Battery Park, New Jersey / Liberty State Park, or both); and your group size. We use this information only to provide the Service and deliver your alerts. We never sell your personal data.
We rely on the following sub-processors to operate the Service: Stripe (payments), Brevo/Sendinblue (email), Twilio (SMS, if and when SMS alerts are offered), Supabase (hosting/database), and Vercel (web hosting). Some of these providers may process data outside your country, subject to appropriate safeguards.
GDPR (EU/EEA/UK). Where the EU/UK General Data Protection Regulation applies, you have the right to access, correct, delete, restrict, or object to the processing of your personal data, the right to data portability, and the right to lodge a complaint with your local supervisory authority. The data controller is Jean-Baptiste Renaldi. To exercise these rights, contact us at hello@soldoutradar.com.
California (CCPA/CPRA). If you are a California resident, you have the right to know what personal information we collect, to request access to or deletion of it, and to correct inaccurate information. We do not sell or share your personal information as those terms are defined under California law, and we will not discriminate against you for exercising your privacy rights. 8. Acceptable Use
You agree to use the Service only for your own lawful, personal purposes. You agree that you will not:
- Use the Service for any unlawful, fraudulent, or abusive purpose, or in violation of any third-party site's terms.
- Use bots, scrapers, crawlers, or any automated means to access, scrape, overload, or interfere with the Service.
- Resell, sublicense, or commercially redistribute the Service or our alerts without our written permission.
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems, or interfere with the Service's normal operation.
- Provide false information, impersonate another person, or use a mobile number you are not authorized to use.
We may suspend or terminate your access at any time, without refund, if we reasonably believe you have violated these Terms.
9. Disclaimers of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that openings will be detected; that alerts will be delivered or delivered on time; or that you will be able to obtain any ticket, tour, or reservation. You use the Service at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, SoldOutRadar and its operator, owners, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost opportunities, lost bookings, or missed events, arising out of or relating to the Service — even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any and all claims relating to the Service is limited to the amount you actually paid us for the Service giving rise to the claim. For the free test plan, our total liability is limited to USD $0.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Changes to the Service or These Terms
We may modify, suspend, or discontinue the Service (or any part of it) at any time. We may also update these Terms from time to time. When we do, we will revise the "Effective date" above and, where appropriate, provide notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, stop using the Service.
12. Governing Law & Venue
SoldOutRadar is operated from France. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of France, without regard to its conflict-of-law rules and without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
The parties agree to submit to the exclusive jurisdiction of the courts located in Marseille, France to resolve any dispute, except where applicable law gives you the right to bring proceedings in another forum.
